Why do decision-makers in similar liberal democracies interpret the same legal definition in very different ways? International law provides states with a common definition of a "refugee" as well as guidelines outlining how asylum claims should be decided. Yet, the processes by which countriesdetermine who should be granted refugee status look strikingly different, even across nations with many political, cultural, geographical, and institutional commonalities. This book compares the refugee status determination (RSD) regimes of three popular asylum seeker destinations - the UnitedStates, Canada, and Australia. Despite similarly high levels of political resistance to accepting asylum seekers across these three states, once asylum seekers cross their borders, they access three very different systems. These differences are significant both in terms of asylum seekers' experienceof the process and in terms of their likelihood of being found to be a refugee. The book moves beyond the claim by some scholars that asylum seeker destinations are uniformly becoming more exclusionary, and the contrary assertions of other scholars that the same destinations are converging on a new inclusive internationalism leading to the decline of state sovereignty. Instead,Hamlin finds these states to be running on three distinct trajectories, none of which are totally restrictive or expansive. Based on a multi-method analysis of all three countries, including a year of fieldwork with in-depth interviews of policy-makers and asylum-seeker advocates, observations ofrefugee status determination hearings, and a large-scale case analysis, Hamlin finds that cross-national differences have less to do with political debates over admission and border control policy than with the level of insulation the administrative decision-making agency enjoys from eitherpolitical interference or judicial review. Administrative justice is conceptualized and organized differently in every state, and so states vary in how they draw the line between refugee and non-refugee.

Idle No More bewildered many Canadians. Launched by four women in Saskatchewan in reaction to a federal omnibus budget bill, the protest became the most powerful demonstration of Aboriginal identity in Canadian history. Behind the Man: John Laurie, Ruth Gorman, and the Indian Vote in Canada is the unique "biography" of Alberta political figure John Lee Laurie, a key proponent of Aboriginal rights in the 1940s and 1950s. In sheer numbers, no form of government control comes close to the police stop. Each year, twelve percent of drivers in the United States are stopped by the police, and the figure is almost double among racial minorities. Police stops are among the most recognizable and frequently criticized incidences of racial profiling, but, while numerous studies have shown that minorities are pulled over at higher rates, none have examined how police stops have come to be both encouraged and institutionalized. Pulled Over deftly traces the strange history of the investigatory police stop, from its discredited beginning as "aggressive patrolling” to its current status as accepted institutional practice. Drawing on the richest study of police stops to date, the authors show that who is stopped and how they are treated convey powerful messages about citizenship and racial disparity in the United States. The last days of colonialism taught America's revolutionaries that soldiers in the streets bring conflict and tyranny. As a result, our country has generally worked to keep the military out of law enforcement. Stop and Frisk: The Use and Abuse of a Controversial Policing Tactic by
No policing tactic has been more controversial than "stop and frisk," whereby police officers stop, question and frisk ordinary citizens, who they may view as potential suspects, on the streets. As Michael White and Hank Fradella show in Stop and Frisk, the first authoritative history and analysis of this tactic, there is a disconnect between our everyday understanding and the historical and legal foundations for this policing strategy. First ruled constitutional in 1968, stop and frisk would go on to become a central tactic of modern day policing, particularly by the New York City Police Department. By 2011 the NYPD recorded 685,000 'stop-question-and-frisk' interactions with citizens; yet, in 2013, a landmark decision ruled that the police had over- and mis-used this tactic. Stop and Frisk tells the story of how and why this happened, and offers ways that police departments can better serve their citizens. They also offer a convincing argument that stop and frisk did not contribute as greatly to the drop in New York's crime rates as many proponents, like former NYPD Police Commissioner Ray Kelly and Mayor Michael Bloomberg, have argued. While much of the book focuses on the NYPD's use of stop and frisk, examples are also shown from police departments around the country, including Philadelphia, Baltimore, Chicago, Newark and Detroit. White and Fradella argue that not only does stop and frisk have a legal place in 21st-century policing but also that it can be judiciously used to help deter crime in a way that respects the rights and needs of citizens. They also offer insight into the history of racial injustice that has all too often been a feature of American policing's history and propose concrete strategies that every police department can follow to improve the way they police. With carbon farming, agriculture ceases to be part of the climate problem and becomes a critical part of the solution Agriculture is rightly blamed as a major culprit of our climate crisis. But in this groundbreaking new book, Eric Toensmeier argues that agriculture--specifically, the subset of practices known as "carbon farming"--can, and should be, a linchpin of a global climate solutions platform. Carbon farming is a suite of agricultural practices and crops that sequester carbon in the soil and in aboveground biomass. But by far, agroforestry practices and perennial crops present the best opportunities for sequestration. While many of these systems are challenging to establish and manage, and would require us to change our diets to new and largely unfamiliar perennial crops, they also offer huge potential that has been almost entirely ignored by climate crusaders. Many of these carbon farming practices are already implemented globally on a scale of millions of hectares. These are not minor or marginal efforts, but win-win solutions that provide food, fodder, and feedstocks while fostering community self-reliance, creating jobs, protecting biodiversity, and repairing degraded land--all while sequestering carbon, reducing emissions, and ultimately contributing to a climate that will remain amenable to human civilization. Just as importantly to a livable future, these crops and practices can contribute to broader social goals such as women''s empowerment, food sovereignty, and climate justice. The Carbon Farming Solution does not present a prescription for how cropland should be used and is not, first and foremost, a how-to manual, although following up on references in a given section will frequently provide such information. Constitutional Labour Rights in Canada: Farm Workers and the Fraser Case by
On 29 April 2011, the Supreme Court of Canada released its much-anticipated decision in Attorney General of Ontario v Fraser, which dealt with the scope of constitutional protection of collective bargaining. The case involved constitutional challenge to an Ontario statute on the grounds that it violated agricultural workers' freedom of association and right to equality by excluding them from the statutory protection that is available to virtually all other private sector workers and by failing to provide them with alternative legislative support for meaningful and effective collective bargaining rights. Although the Court upheld the constitutionality of the legislation by an eight to one majority, it provided four different, and incommensurable, sets of reasons. For the union that instigated the litigation, Fraser is defeat. For the labour movement and their advocated, Fraser is ambiguous. What is clear, however, is that the Supreme Court of Canada was badly divided over the scope of protection that freedom of association provides to the right to bargain collectively.

Winner, American Sociological Association Latino/a Section Distinguished Contribution to Research Book Award The United States currently is deporting more people than ever before: 4 million people have been deported since 1997 -twice as many as all people deported prior to 1996. There is a disturbing pattern in the population deported: 97% of deportees are sent to Latin America or the Caribbean, and 88% are men, many of whom were originally detained through the U.S. criminal justice system. Weaving together hard-hitting critique and moving first-person testimonials, Deported tells the intimate stories of people caught in an immigration law enforcement dragnet that serves the aims of global capitalism. Tanya Golash-Boza uses the stories of 147 of these deportees to explore the racialized and gendered dimensions of mass deportation in the United States, showing how this crisis is embedded in economic restructuring, neoliberal reforms, and the disproportionate criminalization of black and Latino men. In the United States, outsourcing creates service sector jobs and more of a need for the unskilled jobs that attract immigrants looking for new opportunities, but it also leads to deindustrialization, decline in urban communities, and, consequently, heavy policing. Many immigrants are exposed to the same racial profiling and policing as native-born blacks and Latinos. Unlike the native-born, though, when immigrants enter the criminal justice system, deportation is often their only way out. Hailing primarily from Mexico, Jamaica, and smaller countries of the Caribbean, these temporary workers have become entrenched in the Canadian labour force and are the mainstay of many traditional family farms in Canada. Life Interrupted introduces us to survivors of human trafficking who are struggling to get by and make homes for themselves in the United States. Having spent nearly a decade following the lives of formerly trafficked men and women, Denise Brennan recounts in close detail their flight from their abusers and their courageous efforts to rebuild their lives. At once scholarly and accessible, her book links these firsthand accounts to global economic inequities and under-regulated and unprotected workplaces that routinely exploit migrant laborers in the United States. No Man's Land: Jamaican Guestworkers in America and the Global History of Deportable Labor by
From South Africa in the nineteenth century to Hong Kong today, nations around the world, including the United States, have turned to guestworker programs to manage migration. These temporary labor recruitment systems represented a state-brokered compromise between employers who wanted foreign workers and those who feared rising numbers of immigrants. Unlike immigrants, guestworkers couldn't settle, bring their families, or become citizens, and they had few rights. Indeed, instead of creating a manageable form of migration, guestworker programs created an especially vulnerable class of labor. Based on a vast array of sources from U.S., Jamaican, and English archives, as well as interviews, No Man's Land tells the history of the American "H2" program, the world's second oldest guestworker program. Since World War II, the H2 program has brought hundreds of thousands of mostly Jamaican men to the United States to do some of the nation's dirtiest and most dangerous farmwork for some of its biggest and most powerful agricultural corporations, companies that had the power to import and deport workers from abroad. Jamaican guestworkers occupied a no man's land between nations, protected neither by their home government nor by the United States. The workers complained, went on strike, and sued their employers in class action lawsuits, but their protests had little impact because they could be repatriated and replaced in a matter of hours. No Man's Land puts Jamaican guestworkers' experiences in the context of the global history of this fast-growing and perilous form of labor migration.
Out to Work: Migration, Gender, and the Changing Lives of Rural Women in Contemporary China by
Out to Work is a fresh, engaging account of the lives of a group of migrant women who, while in their teens, moved from rural towns to Beijing to take up work as maids, office cleaners, hotel chambermaids, and migrant schoolteachers. Part of the vanguard of China's great rural-urban migration in the 1990s, these women were deprived of an education because their parents were unable to pay school fees for both sons and daughters. They also faced strong objections from parents, who feared for their daughters' safety and reputations. Gaetano kept in touch with several women for over a decade, and her longitudinal perspective and biographical focus provide a rich empirical basis for her analysis. Through sustained and close contact, she learned about the women's employment searches and interviews, first jobs, promotions and job changes, shopping and leisure activities, self-study efforts, illnesses, romantic relationships, and marriage and motherhood. By accompanying them to visit their rural families at festival time, and meeting their coworkers, friends, employers, and eventually even their in-laws, she obtained fascinating insights about their lives. Gaetano shows that the structural constraints the women experienced stem from ideological barriers and discriminatory practices associated with gender and rural-urban hierarchies. To some extent the women themselves accepted prevailing ideas about gendered obligations and propriety and internalized prevailing ideas about rurality's inferior status. However, they sought to transform themselves and realize their aspirations by cultivating social networks that connected them to more desirable jobs and marriage prospects; by careful selection of a future spouse who shared their vision of social mobility; and through smart economic and emotional investments in their spouses, children, and affines. This multifaceted exploration of migrant women's lives demonstrates how the intersection of gendered norms and rural-urban inequalities shaped the women's identities and desires and makes clear the palpable material consequences the decision to migrate made in their lives. Overall, the book convincingly shows that migration for work advances rural women's gender equality and increases their ability to exercise agency and thus their chances to achieve success and build better lives for themselves. But it also makes clear that the socioeconomic mobility they find is inadequate to completely dismantle the wider gender and rural-urban inequalities that have made these women's journeys so difficult.

From its inception in 1966, the Canadian Seasonal Agricultural Worker Program (SAWP) has grown to employ approximately 20,000 workers annually, the majority from Mexico. The program has been hailed as a model that alleviates human rights concerns because, under contract, SAWP workers travel legally, receive health benefits, contribute to pensions, are represented by Canadian consular officials, and rate the program favorably. Tomorrow We're All Going to the Harvest takes us behind the ideology and examines the daily lives of SAWP workers from Tlaxcala, Mexico (one of the leading sending states), observing the great personal and family price paid in order to experience a temporary rise in a standard of living. The book also observes the disparities of a gutted Mexican countryside versus the flourishing agriculture in Canada, where farm labor demand remains high. Based on interviews with Leamington greenhouse growers and migrant Mexican workers, Tanya Basok offers a timely analysis of why the Seasonal Agricultural Workers Program is needed. She argues that while Mexican workers do not necessarily constitute cheap labour for Canadian growers, they are vital for the survival of some agricultural sectors because they are always available for work, even on holidays and weekends, or when exhausted, sick, or injured. Basok exposes the mechanisms that make Mexican seasonal workers unfree and shows that the workers' virtual inability to refuse the employer's demand for their labour is related not only to economic need but to the rigid control exercised by the Mexican Ministry of Labour and Social Planning and Canadian growers over workers' participation in the Canadian guest worker program, as well as the paternalistic relationship between the Mexican harvesters and their Canadian employers.

We Are Left without a Father Here is a transnational history of working people's struggles and a gendered analysis of populism and colonialism in mid-twentieth-century Puerto Rico. At its core are the thousands of agricultural workers who, at the behest of the Puerto Rican government, migrated to Michigan in 1950 to work in the state's sugar beet fields. The men expected to earn enough income to finally become successful breadwinners and fathers. To their dismay, the men encountered abysmal working conditions and pay. The migrant workers in Michigan and their wives in Puerto Rico soon exploded in protest. Chronicling the protests, the surprising alliances that they created, and the Puerto Rican government's response, Eileen J. Su#65533;rez Findlay explains that notions of fatherhood and domesticity were central to Puerto Rican populist politics. Patriarchal ideals shaped citizens' understandings of themselves, their relationship to Puerto Rican leaders and the state, as well as the meanings they ascribed to U.S. colonialism. Findlay argues that the motivations and strategies for transnational labor migrations, colonial policies, and worker solidarities are all deeply gendered.

Beyond Blood: Rethinking Indigenous Identity by
Author Pamela Palmater argues that the Indian Act's registration provisions will lead to the extinguishment of First Nations as legal and constitutional entities. The current status criteria contain descent-based rules akin to blood quantum that are particularly discriminatory against women and their descendants. Beginning with an historic overview of legislative enactments defining Indian status and their impact on First Nations, the author examines contemporary court rulings dealing with Aboriginal rights and the Canadian Charter of Rights and Freedoms in relation to Indigenous identity. For more than a century, government policy towards Aboriginal peoples in Canada was shaped by paternalistic attitudes and an ultimate goal of assimilation. Indeed, remnants of that thinking still linger today, more than thirty years after protests against the White Paper of 1969 led to reconsideration Canada's 'Indian' policy. In A Fatherly Eye, historian Robin Brownlie examines how paternalism and assimilation during the interwar period were made manifest in the 'field', far from the bureaucrats in Ottawa, but never free of their oppressive supervision. At the same time, she reveals how the Aboriginal 'subjects' of official policy dealt with the control and coercion that lay at the heart of the Indian Act. This groundbreaking study sheds new light on a time and a place we know little about. Brownlie focuses on two Indian agencies in southern Ontario - Parry Sound and Manitowaning (on Manitoulin Island) - and the contrasting management styles of two agents, John daly and Robert Lewis, especially during the Great Depression. In administering the lives of the Anishinabek people, the government paid inadequate attention to the protection of treaty rights and was excessively concerned with maintaining control, in part through the paternalistic provision of assistance that helped to silence critics of the system and prevent political organizing. As Brownlie concludes, the Indian Affairs system still does not work well, and 'has come to represent all that is most oppressive about the history of colonization in this country'. First Nations, Identity, and Reserve Life: The Mi'kmaq of Nova Scotia by
Issues of identity figure prominently in Native North American communities, mediating their histories, traditions, culture, and status. This is certainly true of the Mi’kmaw people of Nova Scotia, whose lives on reserves create highly complex economic, social, political, and spiritual realities. This ethnography investigates identity construction and negotiations among the Mi’kmaq, as well as the role of identity dynamics in Mi’kmaw social relationships on and off the reserve. Featuring direct testimonies from over sixty individuals, this work offers a vivid firsthand perspective on contemporary Mi’kmaw reserve life. Simone Poliandri begins First Nations, Identity, and Reserve Life with a search for the criteria used by the Mi’kmaq to construct their identities, which are traced within the context of their different perceptions of community, tradition, spirituality, relationship with the Catholic Church, and the recent reevaluation of the iconic figure of late activist Annie Mae Aquash. Building on the notions of self-identification and ascribed identity as the primary components of identity, Poliandri argues that placing others at specific locations within the social landscape of their communities allows the Mi’kmaq to define and reinforce their own spaces by way of association, contrast, or both. This identification of others highlights Mi’kmaw people’s agency in shaping and monitoring the representations of their identities. With its theoretical insights, this richly textured ethnography will enhance understanding of identity dynamics among Indigenous communities even as it illuminates the unique nature of the Mi’kmaw people.

From Treaties to Reserves: The Federal Government and Native Peoples in Territorial Alberta, 1870-1905 by
Though some believe that the Indian treaties of the 1870s achieved a unity of purpose between the Canadian government and First Nations, in From Treaties to Reserves D.J. Hall asserts that - as a result of profound cultural differences - each side interpreted the negotiations differently, leading to conflict and an acute sense of betrayal when neither group accomplished what the other had asked. Hall explores the original intentions behind the government's policies, illustrates their attempts at cooperation, and clarifies their actions. While the government believed that the Aboriginal peoples of what is now southern and central Alberta desired rapid change, the First Nations, in contrast, believed that the government was committed to supporting the preservation of their culture while they adapted to change. Government policies intended to motivate backfired, leading instead to poverty, starvation, and cultural restriction. Many policies were also culturally insensitive, revealing misconceptions of Aboriginal people as lazy and over-dependent on government rations. Yet the first two decades of reserve life still witnessed most First Nations people participating in reserve economies, many of the first generation of reserve-born children graduated from schools with some improved ability to cope with reserve life, and there was also more positive cooperation between government and First Nations people than is commonly acknowledged. The Indian treaties of the 1870s meant very different things to government officials and First Nations. Rethinking the interaction between the two groups, From Treaties to Reserves elucidates the complexities of this relationship.

With few exceptions, war stories are told as if men were the only ones who plan, fight, are injured by, and negotiate ends to wars. As the pages of this book tell, though, those accounts are far from complete. Women can be found at every turn in the (gendered) phenomena of war. Women have participated in the making, fighting, and concluding of wars throughout history, and their participation is only increasing at the turn of the 21st century. Political and social commentators regularly bemoan the decline of morality in the modern world. They claim that the norms and values that held society together in the past are rapidly eroding, to be replaced by permissiveness and empty hedonism. It insisted on social hierarchy, confined women to subordinate roles, restricted sex toprocreation, centered child-rearing on moral inculcation, and countenanced slavery and the marriage of pre-teenage girls to older men. Our modern era, which began in the late 18th century, has seen the gradual erosion of this morality of higher purposes and the rise of a new morality of self-fulfillment, one that encourages individuals to pursue the most meaningful and rewarding life-path. Far from being permissive or a moralabdication, it demands that people respect each other's choices, that sex be mutually enjoyable, that public positions be allocated according to merit, and that society provide all its members with their minimum needs so that they have the opportunity to fulfill themselves. Where people once servedthe state, the state now functions to serve the people. The clash between this ascending morality and the declining morality of higher purposes is the primary driver of contemporary political and cultural conflict.
